Data Export Terms

1. What these terms cover

These terms apply to the data Crustdata delivers to you through the dashboard, the API, and any file produced by Data Exports ("Data"). They sit alongside your subscription, the Terms of Service and the Privacy Policy. Where they conflict with the website terms, these terms win for Data.

2. Your licence

Crustdata grants you a non-exclusive, non-transferable licence to use the Data inside your organisation for your own business purposes while your subscription runs. You may copy the Data into your own systems, combine it with your own records, and share it with employees and contractors who work for you under confidentiality obligations at least as strict as these terms.

3. What you may not do

You may not:

  1. Sell, rent, sublicense, publish, or give the Data to anyone outside your organisation, in whole or in part, in any form.
  2. Offer the Data, or a product built on it, as a database, list, directory, or enrichment service, or use it to build a product that competes with Crustdata.
  3. Use the Data to train or fine-tune a machine-learning model that reproduces or substitutes for the Data.
  4. Remove or hide any notice that identifies Crustdata as the source.
  5. Use the Data to send unsolicited messages in breach of anti-spam law, to discriminate unlawfully, or to track or profile people in breach of privacy law.
  6. Share an export file or its download link with anyone outside your organisation.

4. Personal data

Much of the Data describes people. For your use of it, you are the controller and you decide the purpose. You agree that you:

  1. Have a lawful basis under the laws that apply to you (GDPR, UK GDPR, CCPA/CPRA and similar) before you use the Data, and use it only for that purpose.
  2. Give people the notices those laws require and answer their requests to access, correct, or delete their records within the time the law allows.
  3. Keep the Data secure with controls appropriate to its sensitivity, and tell Crustdata within 72 hours if you lose control of it.
  4. Delete a person's record from every copy you hold within 30 days after Crustdata tells you that person has opted out, and stop using it at once. Crustdata removes such records from future exports on its side.
  5. Do not use the Data to make decisions with legal or similarly significant effects on a person unless the law allows it and you have your own basis to do so.

5. Export files

  1. Each export run is billed per row written, at the search rate on your plan; premium filters and columns add per-row charges. Failed runs cost nothing.
  2. Crustdata keeps each file so you can download it again. A download link lasts one hour, and anyone who holds the link during that hour can download the file. Treat the link as you would the file.
  3. You are responsible for every copy you make of a file and for who inside your organisation can reach it.
  4. Crustdata may cap rows per export and pause an export that fails repeatedly. It may also withdraw records from future exports when it has to (a removal request, a legal demand, a data-quality issue).

6. When your subscription ends

Your licence ends with your subscription. Within 30 days you delete the Data, including export files and copies in your own systems, and confirm the deletion if Crustdata asks. You may keep records that the law requires you to retain, under these terms, for as long as the law requires.

7. Accepting these terms

You accept these terms each time you tick the box when you create an export. Crustdata records the time of acceptance on the export. An admin who accepts on behalf of a team accepts for everyone in that team.
